Preventing Home Foreclosure or Limiting the Damage

Many of my clients first come to me with concerns about the possible foreclosure of their home. Adjustable Rate Mortgages (ARMs) and plummeting real estate values are driving many Floridians out of their homes. If you haven't waited too long, there may be real options available to protect your home and avoid foreclosure. In most cases, the bank does not want to take your home. Foreclosures are rarely profitable for the banks.

I have a number of different ways to negotiate with your bank. In many cases, the bank will agree to a reaffirmation of your debt. We work to negotiate a change in the terms so that your mortgage is more affordable. Even if we can't keep you in your home, we may still be able to limit the damage to your credit by negotiating a deed in lieu of payment.

Even if it is too late to save your home, filing for bankruptcy may still be beneficial. After a foreclosure, most people still owe the bank money. This can happen in several ways: 1) when the value of your home dropped between the time you took out the mortgage and when you sold your home or were foreclosed upon; 2) if you borrowed money against all of the equity in your home; 3) if you have no equity in the home. If the bank cannot recover the entire mortgage, you still owe the bank the unpaid balance.

If you still owe a mortgage balance on a home you no longer own, filing for bankruptcy could wipe out that debt or make paying it off much easier. This could start you back on the path to good credit.
