Chapter 7 Bankruptcy: Is it right for you?

Under Chapter 7 of the Bankruptcy Code, much of your debt can be discharged (you are no longer legally required to pay the debt) - giving you a clean slate to start over. Some debt, such as taxes, child support payments, and school loans, cannot be discharged through bankruptcy. However, the following liabilities may be discharged in bankruptcy:

  • Credit card debt
  • Medical bills
  • Late fees
  • Unsecured loans (loans not held by personal property or lien)

While some of your property will be sold through bankruptcy litigation to pay some of your creditors, there are exemptions that allow you to keep some of your property.
