Chapter 7 Bankruptcy

Despite the hype, Chapter 7 bankruptcy is still available for most people and small businesses, even after the 2005 change in the bankruptcy laws. It is not available for everyone, but if you qualify it could be the solution you need to finally get out of debt. If you have declared bankruptcy before, within the past eight years, you will not be eligible for Chapter 7 personal bankruptcy and will need to look at filing Chapter 13 bankruptcy.

Chapter 7 is sometimes called "fresh start" bankruptcy because it can relieve you completely of some kinds of debt (such as credit card debts and medical bills) and temporarily stop foreclosure. You will need to co-operate with a Trustee assigned by the court and, in most cases, attend only one hearing.
